About David

		David Polak is not only an attorney who handles personal injury matters for his clients, but he and his wife were victims themselves of a negligent driver. In 1997, a negligent driver ran a stop sign as David was a pasenger in a vehicle lawfully passing through an intersection of a four way stop when the other driver drove through the intersection without stopping before striking the vehicle David was in and causing the car to spin approximately 210 degrees before coming to a stop. As a result, David sustained herniated discs in his cervical (neck), thoracic (mid back) and lumbar (low back) spines.

Serious Injury Threshold

New York State Insurance Law 5102(d) defines what qualifies as a serious injury as follows:

"Serious Injury" means a personal injury that results in: 1.Death, 2.Dismemberment, 3.Serious Disfigurement, 4.A Fracture, 5.Loss of a Fetus, 6.Permanent Loss of use of a bodily organ, member, function, or system., 7.Permanent Consequential Limitation of use of a bodily member or organ, 8.Sgnificant limitation of use of a bodily function or system, 9.A medically determined injury or Impairment of a non permanent nature which prevents the injured person from performing substantially all of the material acts which constitute such persons usual and customary daily activities for not less than 90 days during the 180 days immediately following the occurance of the injury or impairment.
