$150,000 Arbitration Award received after two law firms refuse to take the case.
David received an arbitration award from the American Arbitration Association (AAA) for a female client who sustained a shoulder and neck injury, in the amount of $150,000 on a Supplemental Underinsured Motorist (SUM) claim. This was after two (2) other law firms turned down the case, one of which is a billboard advertising firm. However, when the woman can to David just two weeks before her statute of limitations was to expire, David initiated suit on the underlying claim and obtained settlement from the $25,000 insurance policy limit of the negligent driver and immediately thereafter initiated an arbitration claim. Even though the SUM carrier offered $40,000 before the hearing, the client was awarded $150,000 after a hearing.

A large advertising firm in Buffalo advises a client to take a $5,000 after sustaining a shoulder injury when she fell on a foreign substance that was left on the floor of a large supermarket chain or she should go find another attorney. The client made the right choice and called the law firm where David was practicing. After David was assigned the file, he successfully obtained a $90,000 settlement offer for the client just a short time later.
Large personal injury firm tells client he has no case. David obtains a $60,000.
The same large personal injury firm as above advised a male client, who had slipped and fallen on ice in Amherst and fractured his ankle, that he did not have a case because there was a snow storm in the Buffalo area with record snow fall some 5-6 days prior to the fall. The insurance carrier would not make any settlement offer to the client claiming that there was a storm in progress. However, the client contacted David and after he conducted discovery was offered $60,000 before trial.
David Creates New Case Law in New York against Health Insurance Companies
Shortly after being admitted to practice law, David successfully created new case law in New York State in the case of Nenno v. Blue Cross and Blue Shield of Western New York. Here, David successfully brought a breach of contract action against the health insurance company following an external appeal to the New York State Insurance Department. The case is now cited in the annotated texts of multiple sections of the New York State Insurance Law, as well as cases across the State.
Tractor Trailer struck by Client offered settlement of $275,000 before discovery.
A male client of David’s was side swiped on an Interstate 90 off ramp by a Canadian Tractor Trailer and sustained injury to his neck and low back. Even before conducting any depositions, physical exams, hiring experts, etc., David’s client who returned back to work with pain and difficulty, after being out of work for nearly one year, was offered $275,000 to settle his claim after engaging in early mediation.

David undertook the representation of a client who sustained an injury in a motor vehicle collision is later involved in a second collision months later and is seriously injured. The client underwent a couple arthroscopic surgeries to her wrist and shoulder and major surgery to her neck is offered $350,000 just before jury selection.
